We recently had a case involving an employee who refused to return to work due to covid reasons. He claimed that he could not return to work as he did not want to jeopardize his wife, children and his in-laws that were currently residing with him in the same home. As a company salesman, his job description required dealing with the public on a daily basis.
During our investigation we were able to determine that the subject was in fact leaving his home on numerous occasions to conduct errands. He was observed going to different facilities to conduct business. He interacted socially with store employees and other individuals and otherwize conducted himself able to clearly work as required. On many occasions we were able to place him in various settings around people with detailed proof. We also were able to prove that his inlaws were not concerned at all about his stated fear to be a COVID-19 risk and did not care if he were to come and go to work as he normally would.
